The account funds belong to the ward and not the guardian (Mental Hygiene Law section 81.29). Inform the guardian, review the guardianship order and if necessary contact the court where the order was signed if there is language in the order requiring court approval before a withdrawal may be made. You have 21 days to do all of this. Ultimately the answer to this questions will be yes, pay the IRS.
